Legal notice and data terms of use

This page governs the use of the content published on SectorAtlas. Accessing and consulting the portal implies acceptance of the following terms.

1. Ownership of the database

SectorAtlas is a database built through a substantial investment of financial resources, time and work in obtaining, verifying, organising and presenting its content. The database as a whole, its structure, the selection and arrangement of the data, as well as descriptive texts, translations, classifications, processed metrics and relations between entities are the exclusive property of SectorAtlas.

Individual facts in the public domain remain free; what is protected is the database that collects, selects and organises them, together with all original content produced by SectorAtlas.

2. Legal protection

The database is protected by Directive 96/9/EC of the European Parliament and of the Council on the legal protection of databases, in particular Article 7 (sui generis right of the database maker), and by Italian Law No. 633 of 22 April 1941 on copyright, in particular Articles 64-quinquies and 64-sexies (databases as intellectual works) and Articles 102-bis and 102-ter (rights of the database maker).

Under Article 102-bis of Law No. 633/1941, the maker has the right to prohibit the extraction and re-utilisation of the whole or a substantial part of the database; repeated and systematic extraction or re-utilisation of insubstantial parts that conflicts with the normal exploitation of the database or unreasonably prejudices the maker is also prohibited.

Original texts, descriptions and translations are further protected as intellectual works under the same law. Systematic reproduction of the content for competitive purposes may constitute unfair competition under Article 2598 of the Italian Civil Code.

3. Text and data mining reservation

Pursuant to Article 4(3) of Directive (EU) 2019/790 and Article 70-quater of Law No. 633/1941, SectorAtlas expressly reserves the use of its content for text and data mining, including the training of artificial intelligence systems. The reservation is also expressed in machine-readable form in the pages of the portal.

4. Permitted uses

  • Consulting the content for personal and internal professional use.
  • Quoting individual data points or short excerpts, within the limits of Article 70 of Law No. 633/1941, provided that SectorAtlas is credited as the source with a link to the original page.
  • Any other use expressly authorised in writing by SectorAtlas.

5. Prohibited uses

Unless authorised in writing, it is strictly prohibited to:

  • systematically extract, copy, download or collect the content, including by automated means (scraping, crawling, bots, unauthorised APIs);
  • re-use, republish, distribute or make the content available to the public, in whole or in part, on other websites, applications, databases or services;
  • use the content to build competing products or services or to enrich third-party databases;
  • use the content to train, fine-tune or evaluate artificial intelligence models;
  • remove or alter source and ownership notices.

6. Sanctions

Infringements will be prosecuted before the competent authorities. The rights holder may seek an injunction, the removal of the content and compensation for damages under Articles 156 et seq. and Article 158 of Law No. 633/1941. The unlawful extraction or re-utilisation of the database for profit is also a criminal offence under Article 171-bis(2) of the same law.

7. Governing law

These terms are governed by Italian law and European Union law. Requests for authorisation to use the data and reports of infringements can be sent to SectorAtlas through the contact details provided on the portal.
